Toyota Paint Defect Discount in Memphis, TN
We recently bought several used 2021 Toyota Tundra and Tacoma models that have a primer paint defect. Because of this defect, we are offering a unique discount for each affected model. The defect is a result of the original factory-applied paint, which has the potential to peel off the vehicle over time. Although repairs have been made to each vehicle, the vehicles do not have a salvage or branded title. It's important to note that each affected Tundra and Tacoma is sold as is and is not eligible for the Manufacturer New Vehicle Limited Warranty. However, Chuck Hutton Toyota is offering a special 2-year, 24,000-mile limited powertrain warranty for these models, which is included in the price of each truck. Representations and Warranties of TMS/USA:
1.
TMS/USA represents that as to the Vehicle there is a potential for the original factory-applied paint to peel. Over time, the adhesion between the factory-applied paint primer coat layer and the base metal electrodeposition layer may degrade, causing the paint to peel from the metal body panels ("Paint Primer Defects").
2.
Repairs were made to the Vehicle. Refer to the repair order for details of the repairs.
3.
The Vehicle does not have a salvage or branded title.
4.
The Vehicle is sold AS IS. TMS/USA makes no warranties on the Vehicle and the Vehicle is INELIGIBLE for the Manufacturer New Vehicle Limited Warranty.
5.
The Vehicle is INELIGIBLE for Certification as a Toyota Certified Used Vehicle.
Representations and Warranties by Buyer:
1.
Buyer represents and acknowledges that Buyer was made aware prior to the purchase that the Vehicle was subject to Paint Primer Defects as described above.
2.
Buyer represents that it has had an opportunity to inspect the Vehicle prior to purchase.
3.
Buyer agrees to disclose the Paint Primer Defects to the subsequent purchaser that acquires the Vehicle from Buyer, regardless of whether that purchase is a wholesale or retail transaction.
4.
If Buyer wholesales the Vehicle, Buyer agrees to make it a condition of that wholesale transaction that the wholesale purchaser will be bound by the terms of this Acknowledgement Agreement including, but not limited to, the requirement to disclose the Paint Primer Issue to any subsequent purchaser. This specific disclosure obligation in this Acknowledgement Agreement will expire after the Vehicle is subject to its first retail sale.
5.
Buyer hereby releases TMS/USA from any and all claims or actions that Buyer might have against TMS/USA related to the Paint Primer Defects described above as to this Vehicle.
6.
Buyer hereby agrees to indemnify and defend TMS/USA, its successors, assigns, and affiliates from any and all claims, lawsuit, arbitrations, or other disputes or proceedings arising from or caused by Buyer's failure to comply with the terms of this Acknowledgement Agreement.
